Performing in Education ("Performing in Education," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit resources.performingineducation.com, performingineducation.com, and any related pages, products, courses, emails, and services that link to this policy (together, the "Services"). It also explains the choices and rights you have, including rights under the privacy laws of U.S. states, the European Union, the United Kingdom, Canada, and other jurisdictions.

By using the Services, you acknowledge the practices described in this policy. If you do not agree, please do not use the Services.

1. Who We Are

Performing in Education is the business responsible for the personal information described in this policy (the "controller" under the EU and UK General Data Protection Regulation). You can reach us at any time at help@performingineducation.com.

2. Information We Collect

Information you provide to us

  • Contact and identity information, such as your name and email address, when you fill out a form, create an account, sign up for emails, or contact us.
  • Messages and inquiries, such as the questions you send through our contact form or by email.
  • Account information, such as your login email and password if you create an account to access purchased resources.
  • Purchase and billing information, such as the products you buy, your billing name and address, and transaction details. Payment card information is collected and processed directly by our payment processors; we do not store full payment card numbers.
  • Professional information you choose to share, such as your school, district, grade level, or role, for example when requesting professional development or a purchase order.

Information collected automatically

  • Device and usage information, such as IP address, browser type, device type, operating system, pages viewed, links clicked, referring pages, and the dates and times of your visits.
  • Approximate location derived from your IP address (for example, city or region). We do not collect precise geolocation.
  • Cookies and similar technologies, as described in Section 5.
  • Email engagement information, such as whether you open our emails or click links in them.

Information from third parties

We may receive information from service providers that help us run the Services, such as our website and course platform, payment processors, and email delivery providers (for example, confirmation that a payment succeeded).

Student information

Our Services are designed for educators, administrators, and parents. Please do not submit personal information about students through our forms or accounts. If you believe student information has been shared with us, contact us and we will delete it.

3. How We Use Information

  • To provide the Services, including processing orders, delivering digital resources, and maintaining your account.
  • To respond to your questions, support requests, and contact form submissions.
  • To send transactional messages, such as order confirmations, receipts, account notices, and policy updates.
  • To send newsletters, free resources, and marketing emails when you have signed up for them or where otherwise permitted by law.
  • To understand how the Services are used and to improve our content, products, and website.
  • To protect the security and integrity of the Services and prevent fraud or misuse.
  • To comply with legal, tax, and accounting obligations, and to establish, exercise, or defend legal claims.

We do not use personal information to make decisions based solely on automated processing that produce legal or similarly significant effects about you.

4. Legal Bases for Processing (EEA, UK, and Switzerland)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on the following legal bases:

  • Contract: to provide products and services you request or purchase.
  • Consent: for marketing emails and non-essential cookies where consent is required. You may withdraw consent at any time.
  • Legitimate interests: to operate, secure, and improve the Services and to respond to inquiries, where those interests are not overridden by your rights.
  • Legal obligation: to comply with tax, accounting, and other legal requirements.

5. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, and similar technologies to keep you signed in, remember your preferences, process purchases, measure site traffic, and understand how the Services are used. You can control cookies through your browser settings. Blocking some cookies may affect how the Services work.

Global Privacy Control: Where required by law, we treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of the sale or sharing of your personal information and of targeted advertising for that browser or device.

Do Not Track: Because there is no common industry standard for "Do Not Track" browser signals, we do not currently respond to them. We do honor GPC signals as described above.

6. How We Share Information

We share personal information only as described below:

  • Service providers that perform services on our behalf, such as website and course hosting (including Kajabi), payment processing (such as Stripe or PayPal), email delivery, analytics, customer support, and accounting. These providers may use personal information only to provide services to us.
  • Legal and safety reasons, when we believe disclosure is required by law, subpoena, or legal process, or is necessary to protect the rights, property, or safety of Performing in Education, our users, or others.
  • Business transfers, in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to this policy.
  • With your consent or at your direction.

We do not sell your personal information for money, and we do not sell or share personal information for cross-context behavioral (targeted) advertising. We have not done so in the preceding 12 months. We do not knowingly sell or share the personal information of consumers under 16 years of age.

7. Data Retention

We keep personal information only as long as reasonably necessary for the purposes described in this policy, including to provide the Services, maintain records of purchases, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. For example, we generally keep purchase records for as long as required by tax law, and we keep contact form messages for as long as needed to respond and follow up. When information is no longer needed, we delete or de-identify it.

8. How We Protect Information

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, and our service providers use industry-standard security such as encryption in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by law.

9. Children's Privacy

The Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13 (or under the age of digital consent in your country, such as 16 in parts of the EU). If you believe a child has provided us with personal information, please contact us and we will delete it. Under California law, registered users under 18 may request removal of content they posted by contacting us.

10. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Access / Right to know: to confirm whether we process your personal information and to request a copy of it, including the categories and specific pieces we have collected.
  • Correction: to correct inaccurate personal information.
  • Deletion: to request that we delete personal information we hold about you, subject to legal exceptions.
  • Portability: to receive your personal information in a portable, readily usable format.
  • Opt out: of the sale of personal information, sharing for targeted advertising, and profiling in furtherance of decisions with legal or similarly significant effects. (As stated above, we do not sell or share personal information for these purposes.)
  • Limit use of sensitive information: where applicable. We use sensitive personal information, such as account login credentials, only to provide the Services and as permitted by law, and not to infer characteristics about you.
  • Withdraw consent at any time, where processing is based on consent.
  • Non-discrimination: we will not discriminate against you for exercising your privacy rights, such as by denying services or charging different prices.

U.S. state privacy rights

Residents of states with comprehensive consumer privacy laws, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, may exercise the rights above as provided by their state's law. Minnesota residents may also request a list of the specific third parties to which we have disclosed their personal data, and Oregon residents may request a list of the specific third parties to which we have disclosed personal information. We extend these rights to all U.S. users, regardless of state, to the extent reasonably possible.

Appeals: If we decline to take action on your request, you may appeal our decision by emailing help@performingineducation.com with the subject line "Privacy Request Appeal" within a reasonable time after receiving our decision. We will respond to your appeal in writing within the time required by your state's law and explain the reasons for our decision. If your appeal is denied, you may contact your state Attorney General.

Additional information for California residents

This section supplements this policy as required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"). In the past 12 months, we have collected the following categories of personal information:

  • Identifiers, such as name, email address, account name, and IP address.
  • Customer records described in Cal. Civ. Code § 1798.80(e), such as name, billing address, and phone number if provided. Payment card details are handled by our payment processors.
  • Commercial information, such as products purchased and purchase history.
  • Professional information, such as school, district, or role, if you choose to provide it.
  • Internet or other electronic network activity, such as browsing and interaction with our website and emails.
  • Approximate geolocation derived from IP address.
  • Sensitive personal information, limited to account login credentials, used only to provide your account.

We collect these categories from the sources described in Section 2, use them for the business purposes described in Section 3, and disclose each category for business purposes to the categories of service providers described in Section 6. We retain each category for the periods described in Section 7. We do not sell or share (as those terms are defined by the CCPA) any category of personal information.

Shine the Light: California residents may request information about any disclosure of personal information to third parties for their own direct marketing purposes. We do not make such disclosures.

Nevada residents

We do not sell covered information as defined by Nevada law. Nevada residents may still submit an opt-out request by emailing us, and we will honor it if our practices change.

EEA, UK, and Swiss residents

You have the rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing (including the absolute right to object to direct marketing), as well as the right to withdraw consent. You also have the right to lodge a complaint with your local data protection supervisory authority, or in the UK, the Information Commissioner's Office. We would appreciate the chance to address your concerns first, so please contact us.

Canada, Australia, Brazil, and other locations

Depending on your location, local laws such as Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec's Law 25, Australia's Privacy Act 1988, and Brazil's Lei Geral de Proteção de Dados (LGPD) may give you rights to access, correct, delete, or withdraw consent to the use of your personal information, and to complain to your local privacy regulator. We will honor those rights as required by applicable law.

11. How to Exercise Your Rights

To make a privacy request, email help@performingineducation.com with the subject line "Privacy Request" and tell us what you are requesting and which state or country you live in. You may also use our contact form.

  • Verification: To protect your information, we will verify your identity before fulfilling a request, usually by confirming information we already have, such as your email address. We will only use the information you provide for verification to process your request.
  • Authorized agents: You may use an authorized agent to submit a request on your behalf. We may require signed written permission from you and may ask you to verify your identity directly with us.
  • Timing: We will respond within the time required by applicable law, generally within 30 days for requests under the GDPR and within 45 days for requests under U.S. state laws. Where permitted by law, we may extend this period once and will let you know if we do.
  • Cost: Requests are free, except where the law allows a reasonable fee for requests that are manifestly unfounded, excessive, or repetitive.

12. Email Communications

You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link at the bottom of any marketing email or by contacting us. We will process your request promptly, as required by the U.S. CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), and other applicable laws. Even if you unsubscribe from marketing emails, we may still send you transactional messages about your purchases or account.

13. International Data Transfers

We are based in the United States, and our service providers may process personal information in the United States and other countries. These countries may have data protection laws that differ from those in your country. When we transfer personal information from the EEA, UK, or Switzerland, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or a service provider's certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions.

14. Third-Party Links and Services

The Services may link to websites and services operated by others, such as booksellers, social media platforms, and our main website. We are not responsible for the privacy practices of those third parties, and we encourage you to read their privacy policies.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or the law. When we do, we will update the effective date at the top of this page. If we make material changes, we will provide notice as required by law, such as by email or a notice on the Services.
