Terms of Use

These Terms of Use govern your purchase and use of resources from Performing in Education ("Performing in Education," "we," "us," or "our"), including digital downloads, printables, Google Slides and Google Forms versions, escape rooms, assessments, and all other materials available through resources.performingineducation.com (the "Resources"). By purchasing, downloading, or using any Resource, you agree to these Terms.
1. Ownership and Copyright
All Resources are the original work of Performing in Education and are protected by United States and international copyright law. Purchasing a Resource gives you a limited license to use it as described below. It does not transfer ownership of the Resource or its copyright to you.
2. Your License
All Resources are digital downloads. No physical products are shipped. After purchase, you can access and download your Resources from your account.
When you purchase a Resource, you receive a limited, non-exclusive, non-transferable license for one teacher to use it for personal classroom or homeschool use. You may:
- Print and copy the Resource for students in your own classroom.
- Assign digital versions to your own students through a password-protected learning platform, such as Google Classroom, that only your students can access.
- Keep a copy for your own future use with your own students.
3. What You May Not Do
You may not share, distribute, or post the Resources publicly in any form. Doing so in any way that violates these Terms is copyright infringement and is against the law. This includes, but is not limited to:
- Sharing, emailing, or giving Resources to other teachers, schools, districts, or anyone outside your own classroom.
- Posting Resources, or links to them, on any public website, blog, social media platform, file-sharing site, or public Google Drive, Dropbox, or similar folder.
- Uploading Resources to any public or shared resource library, marketplace, or curriculum platform, whether free or paid.
- Reselling, sublicensing, or redistributing Resources, in whole or in part, including in modified or translated form.
- Sharing your account login so others can access the Resources.
- Claiming the Resources as your own work or removing copyright notices.
Each additional teacher who wants to use a Resource must purchase their own license. For school or district licensing, please contact us.
4. Enforcement: We Will Take Legal Action
We actively protect our work. Unauthorized sharing, distribution, or public posting of our Resources is copyright infringement, and we will pursue every legal remedy available to us. If we discover that you have violated these Terms, we may:
- Immediately terminate your access to all Resources and your account, without refund.
- Issue takedown notices under the Digital Millennium Copyright Act (DMCA) to remove infringing copies wherever they are posted.
- File a civil lawsuit for copyright infringement. Under U.S. copyright law (17 U.S.C. § 504), courts may award damages of up to $150,000 per work for willful infringement, plus attorney's fees and court costs (17 U.S.C. § 505).
- Refer willful infringement to law enforcement for criminal prosecution where permitted by law (17 U.S.C. § 506).
5. Agreement at Checkout
By checking the box at checkout and completing your purchase, you confirm that you have read, understood, and agree to these Terms of Use, including that you will not share, distribute, or post the Resources publicly.
6. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase, and continued use of the Resources after an update means you accept the updated Terms.
